Your Immigration Status Has No Bearing on any Rightful Injury Claim
Your Immigration Status Has No Bearing on any Rightful Injury Claim: By Neil Kalra
Immigrants, regardless of whether they have documentation or not: work at a lot of very dangerous jobs in the US. They work in:
Construction: such as carpenters, bricklayers, ironworkers, demolition workers, and electricians. If they work in Manhattan their jobs can be on the ground or 1,000 feet up.
Food Service: such as waiters, busboys, kitchen help, or food delivery: which finds them on a bicycle whipping through dangerous traffic.
As well as domestics (maids and housekeepers), garment workers, taxi /Uber drivers, and chauffeurs.
Any time, any of these people can be the victim of an accident caused by someone else’s negligence. When that happens, like any US citizen, immigrants, whether they are properly documented or not, have the same rights as anyone else in the United States. This includes making a claim to recover compensation for injuries sustained. And if their claim is unsuccessful, immigrants have the right to sue the defendants and force them to pay. This right is protected by the Constitution of the United States.
When an immigrant suffers a serious injury in an accident caused by someone else’s negligence, their fear of retribution if they are undocumented, can make them feel helpless. Our court system may confuse and terrify them. Often this is because they might think our courts are like those in their home country, many of which are unjust and unfair. Is it any wonder that an immigrant hesitates to file a rightful personal injury claim to recover monetary damages to pay their bills after an accident that happens on any New York job, or on busy New York Street?
Instead of protecting their legal rights, they suffer in silence. But by their silence, they’re allowing those who injured them to not only get away with it, but continue their behavior because no one has stopped them. By not financially protecting their family by filing a claim, injured victims are actually harming themselves and their families.
An immigrant’s fear of our judicial system is reinforced by the groundswell of anti-immigration sentiment expressed by some of our citizens, politicians and in some instances, the media. But that’s just noise. The truth of the matter is that virtually every legal move that has been made to undo our current immigration laws has been overturned by the same US court system that immigrants unreasonably fear. Isn’t that ironic?
The fact is that it takes a constitutional amendment to change immigration laws. And those rarely happen. The last time the Constitution was amended was 1971, 48 years ago.
There are several federal and New York State laws, all affirmed by the courts, that severely punish those who use the immigration system as retribution against immigrants who bring insurance claims for accidents that these negligent defendants cause. So rest easy and file your claim.
And don’t forget, nine out of every ten injury claims never see a courtroom. That’s because successful settlements are negotiated between the victims (and their lawyer) with the insurance company that covers these defendants. So your claim is really no more than a business deal. And that makes things less emotional if you’re smart enough to hire an attorney to represent you. This relieves you of the stress and delivers a fair settlement to you and your family.
